The basis of Leo Donofrio's lawsuit is that since Barack Obama Jr. was born at a time when Kenyan was ruled under British law, Obama was born with dual citizenship of U.S. and British origin.

This Wikipedia page seems to back that up, saying that the British Crown colony in Kenya "came to an end in 1963" (Obama was born in 1961).
